festidy.com is run by Festidy ("Festidy", "we", "us"). By using the site, sending an invitation, or replying to one, you agree to these terms. If you don't agree, please don't use the site.

Who can use Festidy

Festidy is for adults. You must be 18 or older to plan a party, list a business, or reply to an invitation. Children don't use Festidy themselves: a parent or guardian replies for a child and decides what to share about them.

What Festidy is

Festidy is a free planning tool with checklists, ideas, invitations and replies, and links to shops and local vendors. Advice on the site is general and may not fit every party. Use your own judgment, especially around food allergies, safety, and permits.

Invitations, party links, and albums

Each invitation, reply page, and party album opens for anyone who has its link. Festidy doesn't control who receives a link or who it's forwarded to. If you're the host:

• You decide who gets the link, and you're responsible for sharing it only with people you trust. Don't post a party link publicly.
• You're responsible for what you put in the invitation, including the party address and any photos.
• You confirm the people you invite know you, and that you may contact them. Festidy sends invitations, reminders, and updates by email on your behalf, so don't use it for spam or advertising.
• You can delete a party at any time. That removes its replies and album photos from Festidy.

If you're a guest, share only what the host needs, and use children's first names only. Your reply goes to the host, and Festidy keeps it to run the invitation (see the privacy policy). Allergy details are shared so the host can plan; neither Festidy nor the host can promise an allergen-free party.

Photos and other things you add

You keep ownership of the photos, notes, and other content you add. You allow Festidy to store it, show it to people who have the party link, and process it as needed to run the service. We use it in Festidy's own marketing only for vendor listings (below) or with your permission.

Add only content you have the right to share. For any photo in which another family's child can be recognized, you confirm you have permission from that child's parent or guardian. Nothing illegal, hateful, sexual, or meant to harass. We may remove content that breaks these terms or that a parent asks us to take down.

Vendors

Vendors listed on Festidy are independent businesses. Festidy doesn't book, take payments for, or guarantee any vendor's services. Agreements, prices, and payments are between you and the vendor. Vendors are responsible for their own licenses, insurance, and safety; check these yourself, especially for bounce houses, pools, animals, and food. "Verified" means we checked specific details listed on the profile, not that we endorse every aspect of the business.

Vendor listings

If you list a business, you confirm the information is accurate and that you own or have permission to use every photo you upload, including permission from parents for any photo in which a child can be recognized. You allow Festidy to show your listing and photos on the site and in Festidy's own marketing. We may edit, decline, or remove listings at our discretion. Listing is free; placement is based on fit, never on payment. You agree to cover Festidy's costs (including reasonable legal fees) if a claim is brought against Festidy because of your services, your listing, or your photos.

Affiliate links

Some links to shops and services are affiliate links. If you buy through them, Festidy may earn a commission at no extra cost to you. This never changes how we rank or recommend local vendors.

Acceptable use

Don't misuse the site: no spam, false listings, scraping, collecting other people's information, pretending to be someone else, or attempts to break or overload it.

Copyright complaints

If you believe something on Festidy copies your work without permission, send a notice to our copyright agent with:

1. your physical or electronic signature;
2. the work you believe was copied;
3. the material on Festidy and where it is (the link);
4. your name, address, phone number, and email;
5. a statement that you believe in good faith the use isn't authorized by you, your agent, or the law; and
6. a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.

Copyright agent: Festidy, McKinney, Texas, hello@festidy.com (subject line "Copyright"). We remove material that a valid notice identifies. If your material was removed and you believe that was a mistake, you can send a counter-notice to the same address. We close the accounts of people who repeatedly upload others' work.

Disclaimer and limits

Festidy is free and provided "as is", without warranties of any kind. To the extent the law allows:

• Festidy isn't liable for indirect or consequential losses, or for the acts of vendors, guests, hosts, other sites we link to, or anyone who receives a party link.
• Festidy's total liability for any claim about the site is limited to $100.

Nothing in these terms limits liability that the law doesn't allow to be limited.

Covering Festidy for misuse

If someone brings a claim against Festidy because of content you added, a party you hosted, or your breaking these terms, you agree to cover Festidy's reasonable costs of that claim.

Ending use

You can stop using Festidy and delete your parties at any time. We may suspend access that breaks these terms, and we may change or stop any part of the service.

Disputes

If something goes wrong, please email us first; most problems can be fixed quickly. These terms are governed by the laws of the State of Texas, and any dispute goes to the state or federal courts in Collin County, Texas.
